1. Introduction
At talkwith.me, we take your privacy seriously. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our service.
talkwith.me is operated by Track49, a company based in British Columbia, Canada. We are accountable for the personal information in our care and handle it in accordance with the British Columbia Personal Information Protection Act (PIPA), which sets the rules for how organizations collect, use, and disclose personal information. "Personal information" means information that can identify you, such as your name, email address, or profile details.
By using talkwith.me, you agree to the collection and use of information in accordance with this policy. This policy is posted here and is also available on request.
2. Information We Collect
Personal Information: When you create an account, we collect your email address and the username you choose for your link. Your profile may also include a display name, a short description, and an avatar image you upload. If you upgrade, our payment processor collects billing details on our behalf — we never store your full card number.
Meeting Requests: If you enable meeting requests, visitors to your page can submit their name, email address, a short message, and a preferred time so we can deliver the request to you by email. We process this information on your behalf to help coordinate the meeting.
Usage and Technical Information: We collect basic, aggregate usage data such as how often your link is visited, so you can see your own analytics. To operate the service securely, we also process technical data such as IP addresses, which we use for rate limiting and to prevent abuse. We do not record, store, or transcribe the contents of your video calls.
3. How We Use Your Information
We use your information to operate the service, authenticate you, route visitors to your meetings, provide your analytics, process payments, and contact you about your account.
We collect only the information we need for these purposes, and we do not use it for unrelated purposes without your consent.
4. Consent
We collect, use, and disclose your personal information with your consent, except where PIPA permits or requires us to act without it. By creating an account or providing information through talkwith.me, you consent to the uses described in this policy. When a visitor submits a meeting request, they provide that information voluntarily for the obvious purpose of arranging a meeting, which PIPA treats as implied consent.
You may withdraw your consent at any time by contacting us or deleting your account, subject to reasonable notice and any legal or contractual obligations. If you withdraw consent, we may no longer be able to provide some or all of the service.
5. Information Sharing
We do not sell your personal information.
We use your information only for the purposes described in this policy. We share it only with the service providers that help us run talkwith.me, and only as needed to deliver the service. These include Stripe (payment processing), Resend (transactional email), Cloudinary (avatar image hosting), Cloudflare (real-time video connectivity), and our cloud hosting and database providers, Fly.io and MongoDB Atlas. These providers are bound by agreements that require them to protect your information and use it only to provide their service to us.
We may also disclose personal information where required or authorized by law, such as in response to a court order, subpoena, or other valid legal request.
6. Data Security
We use reasonable administrative and technical safeguards to protect your information, including encryption, access controls, and limiting who on our team can access personal data. Video-call media is encrypted in transit: calls connect directly between participants where the network allows, or through a secure encrypted relay when a direct connection is not possible. In either case the media passes through encrypted and is never recorded by us.
No method of transmission or storage is perfectly secure, but we work to protect your data with reasonable measures. If we become aware of a privacy breach that affects you, we will investigate, take steps to contain it, and notify you and, where appropriate, the Office of the Information and Privacy Commissioner for British Columbia.
7. Data Retention
We keep your account information for as long as your account is active, and you can delete your account at any time. Meeting requests are kept only as long as needed to coordinate the meeting and are automatically removed within about two weeks. Sign-in codes expire within minutes, and login sessions expire automatically and are cleared when you sign out or delete your account.
Where we use personal information to make a decision that directly affects you, we retain it for at least one year afterward, as PIPA requires. When information is no longer needed for the purposes we collected it or for legal or business reasons, we securely delete or anonymize it.
Video calls are never retained — rooms exist only in memory and are gone when the call ends.
8. Your Rights: Access and Correction
You have the right to ask for access to the personal information we hold about you, how we have used it, and who we have shared it with. You may also ask us to correct information that is inaccurate or incomplete, or to export or delete your information. To protect your privacy, we may ask you to verify your identity, and access requests should be made in writing to our Privacy Officer (below).
We will respond within 30 days, as PIPA requires. We make reasonable efforts to keep the personal information we use accurate and complete. If we correct your information, we will pass the correction to anyone we shared it with in the past year; if we decline a correction, we will note your requested change on file. If we cannot grant a request, we will explain why in writing and tell you how to escalate.
9. Cookies
We use essential cookies to operate the Service (such as session cookies for authentication). We do not use tracking cookies for advertising purposes.
10. Third-Party Links
Your link can redirect to third-party platforms such as Zoom, Google Meet, or Microsoft Teams. Those services have their own privacy policies, and we are not responsible for their practices.
11. Children's Privacy
talkwith.me is not intended for children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, please contact us and we will remove it.
12. International Transfers
Track49 operates from Canada, but your information is stored and processed in the United States, where our cloud hosting and database providers (Fly.io and MongoDB Atlas) operate, and may be processed in other countries where our service providers are located. By using talkwith.me, you consent to this processing. We take steps to ensure your information remains protected wherever it is processed.
13. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you.
14. Complaints and Contact
Our Privacy Officer, Jack Isherwood, is responsible for our compliance with PIPA. If you have a question, request, or complaint about how we handle your personal information, contact him at privacy@talkwith.me and we will respond as soon as we reasonably can.
